Many employers believe that paying an employee a salary automatically makes them exempt from overtime. In reality, exemption depends on job duties and salary level, not job titles or pay method. Misclassifying employees is one of the most common—and costly—wage & hour violations.
Employers should regularly review salaried positions to ensure employees meet all exemption requirements under the Fair Labor Standards Act (FLSA). A quick review now can prevent back wages, penalties, and Department of Labor investigations later.
Compliance questions today are far less expensive than enforcement actions tomorrow.
