The North Carolina Wage and Hour Act: What Employers Must Know
Unlike Georgia, North Carolina layers its own law, the North Carolina Wage and Hour Act (N.C.G.S. § 95-25.1 et seq.), on top of the FLSA. The NC Department of Labor’s Wage and Hour Bureau enforces it, and its wage-payment rules apply to almost every North Carolina employer, including businesses that are also covered by the FLSA. Many of the problems we find in North Carolina are state-law paperwork issues that the FLSA alone would never flag:
- Written pay notices (§ 95-25.13): Employees must be told in writing, at hiring, what they will be paid and when and where payday is. Any change to promised wages requires written notice at least one pay period in advance.
- Deductions (§ 95-25.8): Outside of deductions required by law, an employer may withhold wages only with a signed, dated written authorization stating the reason. Deductions for uniforms, shortages, damage, or advances without proper authorization are a frequent violation.
- Final pay (§ 95-25.7): Separated employees must receive final wages by the next regular payday, through regular pay channels or by trackable mail if the employee requests it in writing.
- Minimum wage and overtime: North Carolina’s minimum wage tracks the federal $7.25 rate. The NCWHA’s overtime and minimum wage provisions mainly reach employers not covered by the FLSA, so most businesses must still meet the federal rules.
- Liability: Violations can result in unpaid wages plus an equal amount in liquidated damages, along with attorney’s fees, in addition to any federal FLSA exposure.

North Carolina agriculture relies heavily on H-2A and migrant and seasonal workers, which brings in the H-2A wage guarantees and the Migrant and Seasonal Agricultural Worker Protection Act (MSPA) on top of state law. Construction subcontracting, furniture and textile manufacturing, food processing, and hospitality round out the industries where we most often find misclassification, off-the-clock work, and improper deductions.
